Q1.
|
What do I need
before I can perform a criminal background record search on
an individual? |
|
|
|
|
A1. |
You need to have at least the person's name and their date
of birth to perform a search. However, the more information
you can supply, the greater the chances of finding a matching
record. |

Q2. |
Do I need permission from the person I wish to perform
a criminal background record search on, before I perform it? |
|
|
|
|
A2. |
Criminal Background Records are currently classified as “public
records” and therefore you do not need permission to execute
a criminal records search for most purposes. One exception to
this is in the case of employment screening, where permission
is generally required. It is always wise to keep up-to-date
with new laws pertaining to your field of business, so check
your State and local laws. |

Q3. |
What information is contained in a CriminalBackgroundRecords.com
report? SEE SAMPLE |
|
|
|
|
A3.
|
A record typically includes the defendant's name, date of
birth, case number, date of offense, date filed, charge, the
parties involved, county and state of incident, description
of crime committed or accused of, alias names used by offender,
the status of the case, disposition, disposition date, sentence,
and unique characteristics of the individual including height,
weight, eye color, race, and sex. The information contained
in a criminal background record report will vary depending on
the state or county being searched. Regulations, rules and filing
practices vary in each jurisdiction, and as a result the information
contained in a record from one state/county in the country could
significantly differ from that in another. For instance, some
states have pictures available for criminals, which you would
receive, while others do not. |

Q4. |
Will I be charged for a search that comes back with
“no records found”? |
|
|
|
|
A4.
|
Yes. A confirmation of where the search was conducted will
be sent back to you along with the information we used to do
the search, and the fact that no records were found. We have
to charge our customers for the search regardless of whether
or not records are found, because we incur costs every time
we run a search. |

Q5. |
How soon will I receive the results of my criminal
background record search? |
|
|
|
|
A5.
|
Statewide search results typically get back to you within
24 hours. County level searches (which are performed manually)
can take up to three business days. *in some remote locations
of the country (which are not searched very often) the turnaround
time could be longer. |

Q6. |
Why are there only county-wide searches available
in some states? |
|
|
|
|
A6. |
Some states either do not have a statewide criminal data repository
or the data they do have is of lesser quality than that found
at the county district courthouses, sheriff's office, District
Attorney's office, or police department (whichever one is used
in retrieving critical criminal history for that particular
county or region). If these resources provide better information
than what is retrievable at the statewide level, CriminalBackgroundRecords.com
will use the county-wide search as opposed to the statewide.
We only use statewide searches in states that we have access
to up-to-date and accurate information. If we do not have such
access and information, we do not promote nor do we suggest
using such a service. We have access to the largest network
of criminal background record researches, investigators and
repositories in the U.S.A. As new means of accessing information
become available, we will be the first on the Internet to deliver
it to you. Due to the values and ethics of CriminalBackgroundRecords.com,
understand that we test all new third party data to ensure it
is up to our high standards, as we will not use low quality,
inaccurate or incomplete sources of information. |

Q7. |
How far back does the data from CriminalBackgroundRecords.com
go? |
|
|
|
|
A7.
|
Good question! On this website you can go to the state in
which you want to conduct your search. On the state page you
will find the answer to this question and other useful information.
Some of our records go back over 30 years, while others only
go back 7 years. In short, it varies by state. |

Q8. |
Could a county search give different results than
a statewide search? |
|
|
|
|
A8. |
Yes. Most statewide searches are conducted through the use
of computerized repository systems whose data is updated monthly.
A county level search is performed by a professional court researcher
in the county chosen. This search could find records that statewide
searches do not find, as the records could have emerged within
the past thirty days. Statewide searches are only as reliable
as the people updating the new data into the central repository.
Therefore, a county level search could come up with records
that were never uploaded to the state database. The county level
search is the most indepth independent search for a specific
area. Of course the drawback to the county search is its scope.
A statewide criminal background check could find records from
anywhere in the state, records which wouldn't be found just
by searching in one county. The rule of thumb here is; if you
have a good idea of what city/county a person committed a crime
in, or lived in for a substantial amount of years, conducting
a county level search is your best bet. Otherwise, to cover
more ground its best to perform a statewide criminal search. |
